DENPASAR<\/strong> \u2013 The Faculty of Law at Universitas Pendidikan Nasional (FH Undiknas) has taken a significant step in Indonesian legal development by officially filing a petition for a judicial review of Law Number 30 of 2014 concerning Government Administration to the Constitutional Court of the Republic of Indonesia. This move represents FH Undiknas\u2019s academic contribution toward ensuring legal certainty and refining the norms of government administration.<\/p>\r\n\n

Officially Registered at the Constitutional Court<\/h2>\n\n

The petition has been formally registered under Case Number 66\/PUU-XXIV\/2026,<\/strong> dated February 12, 2026. Following this registration, the Constitutional Court will proceed to examine and adjudicate the petition in accordance with applicable procedural laws.<\/p>\r\n\n

\"FH-Undiknas\"<\/figure>\n\n

The petition was filed collectively by members of the FH Undiknas academic community and village government officials. Representing the faculty, the petitioners include Dr. Ni Gusti Agung Ayu Mas Tri Wulandari, S.H., M.H., CCL; I Putu Edi Rusmana, S.H., M.H.; and Putu Wahyu Widiartana, S.H., M.H.. From the student body, the petitioners are Putra Lorenzo, Kadek Jessica Aswanda Putri, Ayu Bang Bahari Ken Widyawati, and I Gusti Ayu Agung Anindya Prameswari Dewi. Representing the village administration is I Nyoman Widhi Adnyana, S.Kom., M.Pd, serving as the Head of Kukuh Village in Tabanan Regency, Bali.<\/p>\r\n\n

The involvement of Kukuh Village is particularly significant as it is a designated partner village for FH Undiknas\u2019s community service programs, ensuring the review reflects the direct link between academic theory and field-level governance. The petitioners are supported by a team of nine legal counsels.<\/p>\n\n

Challenging the Phrase “State Financial Loss”<\/h2>\n\n

The primary focus of this judicial review is the phrase“state financial loss”<\/strong> contained within the Government Administration Law. FH Undiknas views the use of this phrase as creating conceptual ambiguity that negatively impacts the practice of government administration. According to the petitioners, this ambiguity risks blurring the line between administrative errors and criminal acts. Consequently, it creates legal uncertainty for public officials, particularly village heads who deal directly with financial management and public services.<\/p>\r\n\n

\n

State officials who work under and are subject to the Government Administration Law should not exist in the shadow of criminal charges solely due to administrative errors or policy decisions,” the petitioners emphasized in their arguments.<\/p>\r\n<\/blockquote>\n\n

Hope for Constitutional Affirmation<\/h2>\n\n

Through this judicial review, FH Undiknas hopes the Constitutional Court can clarify the boundary between the regime of Administrative Law and Criminal Law, especially regarding cases related to state losses such as corruption. If this boundary is clear, administrative mechanisms can function optimally as instruments for correction and recovery, while criminal law remains proportionally placed for actions that truly meet the elements of a criminal offense.<\/p>\r\n\n

FH Undiknas expressed optimism that the legal arguments presented are sufficiently mature to be seriously considered by the Constitutional Court. The ultimate goal is to create a professional, accountable, and fair government administration climate that encourages public officials to take responsible policy actions.<\/p>\r\n\n
